CLIENT AND PARTICIPANT COMPANIES

​These General Terms and Conditions of Contract (hereinafter, ‘the General Terms and Conditions’) regulate the commercial relationship that arises between, on one side, the user or client, and on the other side, the company Firefly Wellness Retreats The full identification details of the participant companies are as follows:

​ GENERAL TERMS AND CONDITIONS OF THE WEBSITE

​ INTRODUCTION

​ The purpose of this document is to establish and regulate the rules of use and safeguarding of information of the website www.fireflywellnessretreats.com (hereinafter, ‘the Website’), the term ‘Website’ signifying all of the pages and contents owned by Firefly Wellness Retreats which are accessed through the domain www.fireflywellnessretreats.com and its subdomains.
The owner of the Website is Firefly Wellness Retreats.
Through the Website, Firefly seeks to provide its clients with information, room reservation and tourism-related activities, as well as any other service which at the time is deemed appropriate for properly achieving its corporate purpose.
These general terms and conditions regulate the use of the Website service that Firefly makes available to Internet users. By using the Website, you are considered a user of it (hereinafter, ‘the User’), which signifies that you fully and unreservedly accept all of the General Terms and Conditions published by Firefly at the very moment you access the Website and should be aware of the importance of reading them every time you visit the Website.
By accessing the Website, the User is agreeing to be bound by the following General Terms and Conditions, which Firefly recommends that the User print or download and carefully read every time that he/she accesses it. Furthermore, use of the Service is also subject to all notices, regulations of use and instructions brought to the attention of the User by Firefly, which complete the provisions of these General Terms and Conditions, provided that they are not incompatible with them.

  SCOPE OF THE WEBSITE. USER RESPONSIBILITY

  Access to the Website is the sole responsibility of the User. Any risks derived from use of the Website shall be the User’s sole and exclusive responsibility. The following are not guaranteed by Firefly: Website infallibility, availability, continuity, non-existence of deficiencies and security; Website content or information passing through it that is free from viruses or other harmful elements; security in the use that the User makes of the Website.
Firefly shall accept no liability for any loss or damage that may arise from interference, omissions, interruptions, computer viruses, telephone faults or disconnections in the operation of this electronic system resulting from causes beyond the control of Firefly; delays or lockouts in the use of this electronic system caused by deficiencies or overloads in its Data Processing Centre, telephone lines, Internet system or other electronic systems; or damage that may be caused by third parties as a result of unlawful intrusions beyond the control of Firefly.
Mere access to the Website does not imply any commercial relationship between TERRANAM and the User.

  WEBSITE CONTENTS

  Firefly reserves the right to prevent or prohibit access to the Website to any Internet user who introduces any contents that are contrary to the law or immoral and to institute any legal action that it deems appropriate to prevent this type of behaviour.

  CORRECT USE OF WEBSITE CONTENTS

  All of the Website’s contents, including, but not limited to, text, graphics, logos, icons, images, audio clips, data and software collections and their compiling (intellectual property content) are the property of FIREFLEY or our sponsors, partners and licensors, and are protected by intellectual property law.
FIREFLY declares that the intellectual property rights (trademarks, trade names, etc.) that appear on the Website are owned by it and/or are legitimately protected by existing intellectual property legislation.
The User undertakes to use the Website diligently, correctly and lawfully and, in particular, undertakes to refrain from:
a)      Deleting, circumventing or manipulating any copyright, trademark or other information that identifies the rights of Firefly or other rights holders incorporated into the contents of and/or products marketed through the Website, including technical protection devices, digital fingerprints and any information mechanisms that may contain them.
b)      Using any of the contents, in particular information about Firefly obtained from the Website, to send publicity, communications for the purpose of direct sale or, for any other kind of commercial purpose, unsolicited messages addressed to a number of persons.
c)      Reproducing or copying, distributing, allowing access to the public through any form of public communication, changing or modifying the contents, unless authorized by the holder of the corresponding rights or it is legally permissible to do so.
d)      In general, using the contents for purposes that are contrary to the law, morality, generally accepted good practice or public order.
TERRANAM grants no license or permission of any kind over its intellectual property rights or any other property or right related to the Website.

  INTELLECTUAL PROPERTY

  The intellectual property rights over the work contained on the Website belong exclusively to Firefly, unless different ownership is indicated. Any unauthorized reproduction, distribution, marketing or modification of such work constitutes an infringement of the intellectual property rights of Firefly, or other rights holder, and may result in the instituting of any judicial or extrajudicial action to which it may be entitled in the exercising of such rights.
Furthermore, information that the User may access through the Website may be protected by intellectual or other rights. Firefly shall under no circumstances accept liability for any infringements of such rights committed by the User.

  APPLICABLE LAW AND JURISDICTION  

These General Terms and Conditions shall be governed by UK law, which shall also be applicable for any eventualities that are not provided for in terms of interpretation, validity and execution.
Firefly and the User, expressly waiving any other jurisdiction, agree to be subject to the Courts of the city of England for the resolution of any disputes that may arise from the existence, interpretation or application of the General Terms and Conditions, except for cases in which the User has the status of a consumer or user in accordance with applicable laws and this clause shall not apply.  

RESERVATION POLICY

​ Your reservation and the accommodation agreement made with Firefly Wellness is subject to these Terms and Conditions.
RESERVATION REQUIREMENTS AND ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF RESERVATION
Reservations through the Website can only be made by persons of legal age and with full natural capacity to act.  By making a reservation through the Website, you are expressly and unreservedly accepting these General Terms and Conditions, as well as the General Terms and Conditions of Use of the Website, which can be downloaded from the ‘General Terms and Conditions’ section of the Website, located at the bottom of the screen.

  PRE-CONTRACT INFORMATION  

Through the Website, you can make a reservation for tourist accommodation & services in the advertised property(ies). The reservation of accommodation & services is a contract which is signed electronically and generates certain rights and obligations for both the tourism establishment and you.
By making a reservation with Firefly Wellness Retreats through its website, users or clients expressly declare their knowledge, understanding and acceptance of the general terms and conditions of use and reservation. Furthermore, users declare that they are of legal age and have the necessary legal capacity to access the websites of Firefly Wellness Retreats and enter into a contract through them. The user accepts responsibility for confidentially and responsibly safeguarding his/her identity and (where applicable) the password obtained when registering as a client, and not disclosing them to third parties.

PAYMENTS & CANCELLATIONS

Reservations
To reserve your place on a retreat with Firefly Wellness Retreats please complete the booking form and pay a 25% non-refundable deposit within 7 days. 

Payments
Payment can be made by bank transfer

The final balance due 12 weeks prior to the retreat. If final payments are not received this date, we reserve the right to cancel your reservation and accept new reservations for your space. If you do not think you can pay in time, please contact Vicky via email at vicky@fireflywellnessretreats.com

All deposit payments are Non-Refundable. Travel Insurance is recommended and the risk falls on you if you decide not to get the travel insurance.

CANCELLATION OF THE RESERVATION:

In order to cancel a reservation, the client must email Firefly at vicky@fireflywellnessretreats.com to inform us of their desire to cancel the reservation. Firefly will respond, confirming the cancellation of the reservation as well as the terms applied. The terms depend on the type of reservation selected and are detailed below:

If cancellation takes place more than 60 days prior to your retreat any payments made will be refunded minus your deposit. If cancellation takes place between 30-60 days prior to your departure, 50% of the retreat price will be forfeited. If cancellation takes place less than 30 days prior to your departure date, 100% of the retreat price will be forfeited. Any amount forfeited, which has not then been paid to by you, will be recovered from you by us as a debt due and payable. 

Retreat Cancellations 
In the rare case that the retreat needs to be cancelled. We will offer a transfer to another retreat or a full refund of your funds. We are not responsible for any expenses or damages incurred as a result of retreat cancellation including preparation costs, airline tickets, travel documents or other expenses. You will not be entitled to claim any additional amounts or seek any compensation for any injury, loss, expenses or damage (either direct or consequential) or for any loss of time or inconvenience which may result from such cancellation (including but not limited to visas, gear purchases, airport and airline taxes).

CONFIRMATION OF THE RESERVATION: Once the reservation is made, the client will be sent a reservation confirmation by email.  

CONFORMITY OF THE ACCOMMODATION: Firefly guarantees that its accommodations conform with the descriptions provided on this website. The reserved accommodation may not exactly match the photographs, but it will be of the same style, as per the description on the website. ​

OFFICIAL COMPLAINTS FORMS: Available to the client at all establishments are official complaints forms.

Flights
Retreats do not include flights and you will therefore be responsible for making your own air travel arrangements. If anybody needs help with flights, please contact us at Firefly Wellness Retreats direct on 00447800974996 or email us with your enquiry to Vicky@fireflywellnessretreats.com. We suggest arriving a few days prior to the retreat to recover from the flight.  Please confirm your flight details with us as soon as they have been made. We cannot be held responsible for any delays, cancellations caused by the airlines, agents or operators.  

Visas/Passports

The cost of this retreat does not include visas, you are responsible for arranging your own visa. You are solely responsible for having valid passports and any visa's required.

4. LIMITATION OF LIABILITY ​

As a customer of Firefly Wellness, you acknowledge that during a retreat you participate voluntarily in any and all activities arranged by the retreat hosts, and insofar as legally permissible, forfeit your right to any cause of action against Firefly Wellness (Firefly Wellness Retreats) arising from any loss or damage to person or property that occurs during a retreat. 
As a customer of Firefly, you hereby agree to be responsible for your own welfare and accept any and all risks of delay, unanticipated events, inconveniences, illnesses, injuries, emotional trauma or death. 
You hereby certify that you are physically fit and have not been advised to not participate, by any means or in any manner, in any activity arranged by Firefly Wellness, by a qualified medical professional.
You hereby certify that there are no health-related reasons or problems which preclude your participation in any and all activities arranged by the retreat hosts.
You hereby waive, release and discharge from and against any and all liability from your participation in the trip and in any and all activities arranged by the retreat hosts, including but not limited to, liability arising from the negligence or fault of Firefly Wellness and/or its employees and/or its collaborators and/or its subcontractors, for your death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to you including your trip to and from activities arranged by the retreat hosts.
You agree that this release shall be legally binding upon you personally and all members of your family. ​

PHOTO / VIDEO RELEASE FORM

​You hereby grant Firefly Wellness the right and permission to use photos & videos in which you are featured and were taken during the retreat. Firefly Wellness holds the right to use this material for advertising and promotional purposes. You hereby release and discharge Firefly Wellness from any claims and demands arising out of the use of the photographs and footage, without limitation of any and all claims for libel or invasion of privacy. ​

OTHER TERMS TO CONSIDER
CHECK-IN
Check-in is between 3PM-5PM. Guest will be required to present a valid government issued photo ID and valid credit card on request.
CHECK-OUT
Check-out is at 11am unless otherwise stated. If you require a later check-out, please contact us before 9 am on the day of departure, and we will do our best to accommodate your needs.
PET POLICIES
Pets are not allowed.​

AGE RESTRICTIONS

Guests must be 18 years or older to check in without a parent or legal guardian. A valid government issued photo ID must be presented at the time of check in for age verification and on request valid credit card.

CHILDREN

Firefly is an adult oriented Wellness Retreat establishment.

YOUR TRAVEL SAFETY​ ​

The safety of our clients and team members remains our top priority. We are proud to maintain the highest standards of cleanliness and hygiene.
In response to the coronavirus disease (COVID-19) outbreak, we have taken additional measures to make our cleaning and hygiene protocols even more rigorous.
We have increased the frequency of cleaning our public spaces and keys (including door handles, public bathrooms, etc.) and continue to use a quality disinfectant.
We have increased the deployment of antibacterial hand disinfectants.

RESTRICTIONS FOR VISITORS

  Entry of visitors into other countries will be subject to the regulations and restrictions of the government in force at the time of arrival.
Clients who do not meet the entry requirements of the government, present signs and symptoms of COVID-19 or do not comply with the regulations of the Ministry of Health in force at the time of arrival will not be allowed to check-in at Firefly.
We will adapt our measures according to the current government directives provided by the Ministry of Health.
We apologize for any inconvenience and thank you for your understanding.
The safety and security of our guests and team members remain our highest priority. We take great pride in maintaining the highest standards of cleanliness and hygiene.  

Firefly reserves the right to make any amendments that it deems appropriate to these General Terms and Conditions without prior notice. These amendments may be made through the company’s websites and shall be legally binding to all for the duration of their publication on the Website, except to clients who made reservations under the terms of the previous general terms and conditions, which shall remain applicable to them. Firefly also reserves the right to apply, in certain cases, when it deems it appropriate, Special Terms and Conditions of Contract which shall take precedence over these General Terms and Conditions and shall be announced in a timely and appropriate manner.
